Terms of Use
The rules for using this website, what our quotes actually mean and what we do and do not promise here. Short version: quotes are estimates, and the job terms live in the signed paperwork.
1. About these terms
This website is operated by Rock On Enterprises, Inc., doing business as Rock On Trucks. These terms are an agreement between you and Rock On. By browsing rockontrucks.com, submitting a form or downloading a document from it, you agree to them. If you do not agree, please do not use the site.
These terms cover the website only. Actual hauling, material supply and repair work is governed by the separate quote, credit application, purchase order, contract or work order that covers that job. If something in those documents conflicts with something here, those documents control the work.
3. Using this site
You may view, print and download material from this site for your own business use in evaluating or working with Rock On. That is what it is here for.
What you may not do
- Use the site or its forms for anything unlawful, fraudulent or misleading.
- Submit false information, or submit someone else's personal information without their permission, including fake quote requests or applications.
- Scrape, harvest or bulk copy the site, its content or contact information, whether by hand or with bots and automated tools.
- Send spam, malware or anything designed to damage, disable or overload the site.
- Try to reach accounts, systems, data or administrative areas you are not authorized to use.
- Copy, republish or resell our content, photos or documents as your own.
- Frame the site, or use our name, logo or marks in a way that suggests a partnership, sponsorship or endorsement that does not exist.
We can limit or block access to the site for anyone who does these things.
4. Intellectual property
The content on this site, including text, photographs of our fleet, equipment and facilities, graphics, logos, page design and downloadable documents, is owned by Rock On Enterprises, Inc. or used with permission, and is protected by copyright and trademark law. The Rock On Trucks name and logo are our marks.
Third party names, logos and award marks shown on the site belong to their owners and appear only to identify that organization or that recognition.
Nothing on this page grants you a license to use our content or marks beyond the personal business use described in section 3. If you want to use something, ask first at [email protected].
5. What you send us
When you send a quote request, application, message or file through this site, you confirm that the information is accurate and that you have the right to share it. We handle personal information as described in our Privacy Policy.
Please do not send confidential or sensitive material through website forms. Use the secure forms on our Resources page or contact our office instead.
Submitting a form does not by itself create a contract, a business relationship, an employment relationship or a job offer. If you send us an unsolicited idea, suggestion or feedback about the site or our services, we are free to use it without owing you anything for it.
6. External links & third party forms
This site links to services we do not control. That includes Adobe eSign forms used for driver and owner operator applications, ACH and W-9 paperwork and other onboarding documents, PDF documents, and our pages on Facebook and YouTube.
Those services have their own terms and privacy policies. Once you leave rockontrucks.com, you are covered by theirs, not ours. We link to them because they are useful, not as an endorsement of everything on them, and we are not responsible for their content, their availability or how they handle your information.
7. No warranty
This website is provided on an "as is" and "as available" basis. We work to keep it current and correct, but we do not warrant that the site will be uninterrupted, error free or free of harmful components, or that content such as service descriptions, specifications, availability, pricing, documents or forms is complete, current or accurate at any given moment.
To the fullest extent allowed by law, we disclaim all warranties for the website, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
This section is about the website. It does not limit any warranty or obligation contained in a signed contract for hauling, material supply or repair services.
8. Limitation of liability
To the fullest extent allowed by law, Rock On Enterprises, Inc. and its owners, officers, employees and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business, delay or loss of data, arising out of your use of, or inability to use, this website or anything you download from it. That includes reliance on a quote or estimate that was later revised or withdrawn, as described in section 2.
Our total liability relating to the website will not exceed one hundred dollars ($100).
Some states do not allow certain limitations or exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law, and nothing here changes our obligations under a signed contract for services.
9. Your responsibility
If your misuse of this website, or your breach of these terms, leads to a claim against us, you agree to cover our reasonable costs and losses from that claim, including reasonable attorney fees.
10. Privacy
Our Privacy Policy explains what we collect through this site, how it is stored and shared, the analytics and advertising cookies in use, the consent language on our forms and how to request deletion. It is part of these terms.
11. Governing law
These terms, and any dispute about this website, are governed by the laws of the State of Minnesota, without regard to its conflict of law rules.
You agree that any legal action about this website will be brought in the state or federal courts located in the State of Minnesota, and you consent to those courts hearing the matter.
Again, this covers the website. Contracts for hauling, material supply and repair services carry their own terms.
12. Changes & severability
We can update these terms. The version posted on this page is always the current one, with the "Last updated" date at the top. Continuing to use the site after a change means you accept the updated version.
If a court finds any part of these terms unenforceable, that part is limited or removed and the rest stays in effect.
